These terms apply to all users, including restaurant owners, managers, staff members, and any other individuals who access our platform.

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any modifications constitutes acceptance of the updated terms. We recommend reviewing these terms periodically to stay informed of any changes.

Service Description

accultlrai provides restaurant analytics software and related services, including table turnover reporting, revenue analysis, predictive planning tools, and operational dashboards. Our services are designed to help restaurant operators optimise their operations through data-driven insights and reporting capabilities.

We provide our services on a subscription basis, with different tiers available to meet varying business needs. Service features, functionality, and availability may vary depending on your subscription plan and may be subject to change as we continue to improve and expand our platform.

User Obligations

As a user of our services, you agree to:

  • Provide accurate, complete, and up-to-date information when creating your account and using our services
  • Maintain the confidentiality of your account credentials and be responsible for all activities under your account
  • Use our services only for lawful purposes and in accordance with these terms
  • Not attempt to gain unauthorised access to our systems, other user accounts, or any part of our services
  • Not use our services to transmit harmful, offensive, or illegal content
  • Not reverse engineer, decompile, or attempt to extract source code from our software
  • Not resell, redistribute, or provide access to our services to third parties without our written consent
  • Comply with all applicable laws and regulations when using our services

Account Registration and Access

To access our analytics platform, you must create an account by providing required information including your name, email address, company details, and payment information. You are responsible for maintaining accurate account information and promptly updating any changes.

You may not create multiple accounts, share account credentials, or allow unauthorised individuals to access your account. We reserve the right to suspend or terminate accounts that violate these terms or pose security risks to our platform or other users.

Payment Terms

Our services are provided on a subscription basis with fees determined by your selected plan and usage. Payment is due in advance according to your billing cycle (monthly or annually). All fees are non-refundable unless specifically stated otherwise in your service agreement.

You authorise us to charge your designated payment method for all applicable fees. If payment fails, we may suspend your access to our services until payment is received. We reserve the right to change our pricing with reasonable notice to existing customers.

Intellectual Property

The accultlrai platform, including all software, content, trademarks, logos, and documentation, is the exclusive property of accultlrai AS and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use our services in accordance with these terms.

You retain ownership of any data you input into our platform. However, you grant us a licence to use, process, and analyse this data solely for the purpose of providing our services to you. We may use aggregated, anonymised data for service improvement and industry research purposes.

You may not copy, modify, distribute, sell, or lease any part of our services or software. Any unauthorised use of our intellectual property may result in immediate termination of your access and potential legal action.

Data Protection and Privacy

We are committed to protecting your privacy and personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR). Our collection, use, and protection of personal data is governed by our privacy policy, which forms an integral part of these terms.

You are responsible for ensuring that any personal data you provide to us or process through our platform is collected and used in compliance with applicable privacy laws. You must obtain necessary consents and provide appropriate notices to individuals whose data may be processed through our services.

Service Availability and Performance

We strive to maintain high availability and performance of our services, but we cannot guarantee uninterrupted or error-free operation. Our services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with reasonable notice when possible. We are not liable for any inconvenience or loss resulting from service interruptions or modifications.

Limitation of Liability

To the maximum extent permitted by law, accultlrai AS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.

Our total liability to you for any claims arising from these terms or your use of our services shall not exceed the amount you paid to us for services in the twelve months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless accultlrai AS, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our services, violation of these terms, or infringement of any third-party rights.

Governing Law

These terms are governed by and construed in accordance with the laws of Denmark, without regard to conflict of law principles. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Denmark.

If you are a consumer residing in the European Union, you may also have rights under the consumer protection laws of your country of residence, and nothing in these terms affects those rights.

Dispute Resolution

We encourage you to contact us directly to resolve any disputes or concerns about our services. If informal resolution is not possible, disputes may be resolved through binding arbitration or in the competent courts of Denmark, depending on the nature and value of the dispute.

Termination

Either party may terminate your access to our services at any time, with or without cause, by providing reasonable notice. Upon termination, your right to use our services immediately ceases, and we may delete your account and associated data in accordance with our data retention policies.

We may immediately suspend or terminate your access without notice if you violate these terms, engage in fraudulent activity, or pose a security risk to our platform or other users. Termination does not relieve you of any payment obligations incurred prior to termination.

Upon termination, you may request export of your data within a reasonable timeframe, subject to technical feasibility and applicable legal requirements. After this period, your data may be permanently deleted from our systems.

Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.
